72-2282. Notice of nonrenewal or rejection of administrator's contract; change of terms. (a) Written notice of a board's intention to not renew the contract of employment of an administrator shall be given to the administrator on or before the third Friday in May of the year in which the term of the administrator's contract expires. An administrator shall give written notice to a board on or before the 14th calendar day following the third Friday in May of the administrator's rejection of renewal of a contract of employment.

(b) Terms of a contract may be changed at any time by mutual consent of both an administrator and a board.

CASE ANNOTATIONS

1. Cited on question of timely appeal from school board decision not to renew teacher contract. Atkinson v. U.S.D. No. 383, 9 Kan. App. 2d 175, 675 P.2d 917 (1984).

2. Cited; rights of tenured versus nontenured administrators examined. Burk v. Unified School Dist. No. 329, Wabaunsee Cty., 646 F. Supp. 1557, 1562 (1986).

3. School district complied with act in not renewing principal's contract; did not violate due process. Peterson v. Unified School Dist. No. 418, 724 F. Supp. 829, 831, 833 (1989).

4. Act does not create property right in continued employment; past renewals do not create property right. Pierce v. Engle, 726 F. Supp. 1231, 1236 (1989).

5. Administrative policy patterned after section held to protect property interest; board properly followed its policy. Kosik v. Cloud County Community College, 250 Kan. 507, 513, 827 P.2d 59 (1992).

6. Kansas administrators' act's statutory procedural rights do not invoke due process protections. Brown v. U.S.D. No. 333, 261 Kan. 134, 140, 928 P.2d 57 (1996).

7. Plaintiff not deprived of constitutionally protected property or liberty interests; plaintiff's resignation from school principal position waived her rights under the Kansas Administrators' Act. Stead v. USD No. 259, Sedgwick County, 92 F. Supp. 3d 1088, 1103-05 (D. Kan. 2015).
