CASE ANNOTATIONS

1. Section unconstitutional on grounds it contravenes Kansas Constitution, Bill of Rights, sections 5 and 18. Kansas Malpractice Victims Coalition v. Bell, 243 Kan. 333, 757 P.2d 251 (1988).

2. Legislative limitation on recovery of noneconomic damages (K.S.A. 60-19a01, 60-19a02) as not violating any constitutional rights determined. Samsel v. Wheeler Transport Services, Inc., 246 Kan. 336, 340, 789 P.2d 541 (1990).

3. Statutory limitations on noneconomic damages violates right to jury trial guaranteed by Kansas constitution. Mahomes-Vinson v. U.S., 751 F. Supp. 913, 924 (1990).

4. On question certified (K.S.A. 60-3201 et seq.), K.S.A. 40-3403(h) abrogating certain common-law vicarious liability held constitutional. Bair v. Peck, 248 Kan. 824, 835, 811 P.2d 1176 (1991).
