IN GENERAL (1-4)

1. Commissioner (director) is to hear and determine the matters presented. Employers' Liability Assurance Corp. v. Matlock, 151 Kan. 293, 297, 98 P.2d 456 (1940).

2. Commissioner (director) is directed by legislative mandate to hear and determine matters presented, and to make findings or award as he shall determine fair and equitable under provisions of the act. Wilson v. Santa Fe Trail Transportation Co., 185 Kan. 725, 738, 347 P.2d 235 (1959).

3. Arbitration begun by widow is merely suspended by her death. Pursley v. Liggett, 130 Kan. 303, 286 P. 201 (1930).

4. Mentioned; no mandatory arbitration prior to maintenance of proceeding. Peschka v. Wilkinson Drilling Co., 192 Kan. 126, 128, 130, 386 P.2d 509 (1963).
