23-2201. Title and application of act. (a) K.S.A. 23-2201 and 23-2205 through 23-2225, and acts amendatory thereto and supplemental thereof, shall be known and may be cited as the Kansas parentage act.

(b) Proceedings concerning parentage of a child shall be governed by this act except to the extent otherwise provided by the Indian child welfare act of 1978 (25 U.S.C. §§ 1901 et seq.).

CASE ANNOTATIONS

1. Cited; trial court correct in refusing blood test order (K.S.A. 38-1117, 38-1118) in motion on modifying divorce decree (K.S.A. 60-260). In re Marriage of Zodrow, 240 Kan. 65, 69, 70, 727 P.2d 435 (1986).

2. Child has interest in support, inheritance, family bonds and identification to justify determination of parentage under act. In re Marriage of O'Brien, 13 Kan. App. 2d 402, 407, 772 P.2d 278 (1989).

3. When parentage determined under act, child support orders also governed by act. State ex rel. Dix v. Plank, 14 Kan. App. 2d 12, 14, 780 P.2d 171 (1989).

4. Trial court's finding it was not in child's best interests to order blood tests reversed. Jensen v. Runft, 252 Kan. 76, 77, 843 P.2d 191 (1992).

5. Cited in dissent; workers compensation judge may determine parentage for purposes of workers compensation benefits only. R.L.J. v. Western Sprinkler, Inc., 17 Kan. App. 2d 749, 754, 844 P.2d 37 (1992).

6. Act contemplates minors as parent; no exception regarding duty of support. State ex rel. Hermesmann v. Seyer, 252 Kan. 646, 652, 847 P.2d 1273 (1993).

7. Under facts, putative father of child born to another man's wife had no constitutionally protected interest in determination of child's paternity. In re D.B.S., 20 Kan. App. 2d 438, 440, 888 P.2d 875 (1995); Aff'd. 258 Kan. 396, 903 P.2d 1345 (1995).

8. Post judgment motions for reconsideration filed without challenging jurisdiction waived lack of personal jurisdiction defense. Carrington v. Unseld, 22 Kan. App. 2d 815, 818, 923 P.2d 1052 (1996).

9. "Parent" broadly construed in K.S.A. 38-1501 et seq. to avoid undue limitation on state's power in parental rights termination case. In re A.N.P., 23 Kan. App. 2d 686, 687, 934 P.2d 995 (1997).

10. Incarceration in correctional facility not legal justification for suspension or modification of child support obligation under guidelines. Rupp v. Grubb, 265 Kan. 711, 712, 962 P.2d 1074 (1998).

11. A Ross hearing must be held prior to ordering blood tests to determine parentage. Ferguson v. Winston, 27 Kan. App. 2d 34, 996 P.2d 841 (2000).

12. When alleged father appears and asserts parental rights, court is to determine parentage pursuant to K.S.A. 38-1110 through 38-1132. In re Adoption of A.A.T., 42 Kan. App. 2d 1, 210 P.3d 640 (2009).

13. An unmarried person who seeks to establish a parent-child relationship with a child conceived using assisted reproductive technology must attempt to do so by using the procedure set forth in the Kansas parentage act. In re W.L., 56 Kan. App. 2d 958, 441 P.3d 495 (2019).
