22-4901. Citation of act. K.S.A. 22-4901 through 22-4911 and 22-4913, and amendments thereto, shall be known and may be cited as the Kansas offender registration act.

Requirement for sexual offenders to register; exception for certain acts done prior to July 1, 2001. 2003-20.

Act requires registering law enforcement agency to register and verify registration of civilly committed sexually violent predators residing at special hospital located in county. 2016-1.

CASE ANNOTATIONS

1. Act's registration requirements remedial and constitutional, but public disclosure provision, as applied to defendant, violates ex post facto prohibition. State v. Myers, 260 Kan. 669, 923 P.2d 1024 (1996).

2. Mentioned that juvenile adjudications for sex offenses disallowed in holding pre-1996 aggravated escape from custody section (K.S.A. 21-3810) inapplicable to juvenile adjudications. State v. Clint L., 262 Kan. 174, 178, 936 P.2d 235 (1997).

3. Conviction for burglary and theft of woman's underwear sexually motivated; registration required hereunder. State v. Patterson, 25 Kan. App. 2d 245, 963 P.2d 436 (1998).

4. Registration and notification provisions of Kansas Offender Registration Act not violative of constitutional provisions prohibiting cruel and unusual punishment (conviction of indecent solicitation of 15-year-old). State v. Snelling, 266 Kan. 986, 989, 975 P.2d 259 (1999).

5. Conviction under act requires registration and public access of such; no preregistration hearing required, act not violative of procedural due process nor cruel and unusual. State v. Wilkenson, 269 Kan. 603, 9 P.3d 1 (2000).

6. In accepting plea of nolo contendere to misdemeanor sexual battery, court not obliged to advise defendant of requirement to register as a sex offender. State v. Legg, 28 Kan. App. 2d 203, 13 P.3d 355 (2000).

7. No ex post facto violation if criminal violation charged occurs after effective date of statute providing punishment for violation. State v. Armbrust, 274 Kan. 1089, 59 P.3d 1000 (2002).

8. Court sentencing defendant for involuntary manslaughter not required to certify him as a violent offender. State v. Lazos, 32 Kan. App. 2d 680, 87 P.3d 345 (2004).

9. Cited; no ex post facto violation involving 2006 amendments to K.S.A. 22-4903; district court reversed. State v. Cook, 286 Kan. 766, 768, 187 P.3d 1283 (2008).

10. Journal entry clarified crime was sexually motivated; district court affirmed. State v. Garcia, 288 Kan. 761, 207 P.3d 251 (2009).

11. Specific intent is not necessary for there to be an offense committed under K.S.A. 22-4903. In re C.P.W., 289 Kan. 448, 213 P.3d 413 (2009).

12. Probation condition requiring defendant to post signs on house and car declaring his sex offender status not authorized. State v. Schad, 41 Kan. App. 2d 805, 206 P.3d 22 (2009).

13. A juvenile adjudication does not qualify as a conviction for purposes of K.S.A. 22-4906(a). State v. Reese, 42 Kan. App. 2d 388, 212 P.3d 260 (2009).

14. Defendant convicted under K.S.A. 21-3505(a)(1) and ordered to register as a sex offender; affirmed. State v. Coman, 42 Kan. App. 2d 592, 214 P.3d 1198 (2009).

15. Lifetime registration requirements for sex offender under the Kansas offender registration act are not a "punishment" for purposes of constitutional analysis. State v. 16. Registration requirement held to be a collateral consequence of conviction and did not render a person "in custody" for purposes of habeas review. Fulbright v. Biltort, 336 F. Supp.3d 1347, 1351, 1352 (D. Kan. 2018).

17. Kansas offender registration act applies to convictions for sexual battery under municipal ordinances that are comparable to state law. City of Shawnee v. Adem, 58 Kan. App. 2d 560, 472 P.3d 123 (2020), rev. granted (Nov. 20, 2020).
