CASE ANNOTATIONS

1. Trial court ruling that K.S.A. 21-4302 required finding no violation hereunder reversed; K.S.A. 21-4302 (1)(d) and (3) held unconstitutional. State v. Nelson, 210 Kan. 439, 440, 441, 448, 502 P.2d 841.

2. Burden on state to prove defendant in gambling place; legislature intended principal use of structure be considered. State v. Schlein, 17 Kan. App. 2d 434, 440, 839 P.2d 58 (1992).

3. Phrase "gambling place" examined; no requirement that premises had previously been used for gambling. State v. Schlein, 253 Kan. 205, 212, 854 P.2d 296 (1993).
