CASE ANNOTATIONS

1. Information charging officer with unlawful introduction of dry yeast into penitentiary did not state criminal offense. State v. Bishop, 215 Kan. 481, 484, 524 P.2d 712.

2. Title of this section not violative of Article 2, § 16 of the Constitution of the state of Kansas. State v. Roseberry, 222 Kan. 715, 717, 567 P.2d 883.

3. Violation not a felony inherently dangerous to human life; will not support felony murder charge. State v. Brantley, 236 Kan. 379, 383, 691 P.2d 26 (1984).

4. Term "penal institutions" includes county jails; unauthorized possession of contraband prohibited in county jails. State v. Cole, 238 Kan. 370, 373, 710 P.2d 25 (1985).

5. Inmate's possession of alcoholic liquor as incorporated into regulation at state penal institution noted. Shepherd v. Davies, 14 Kan. App. 2d 333, 338, 789 P.2d 1190 (1990).

6. Statute noted where admissibility of acts constituting crimes that has been expunged at issue. Pope v. Ransdell, 251 Kan. 112, 124, 833 P.2d 965 (1992).

7. Section held not to be an unlawful delegation of legislative authority violative of the separation of powers doctrine. State v. Ponce, 258 Kan. 708, 907 P.2d 876 (1995).

8. Section not unconstitutionally vague; legislature may give jailers authority to determine what items constitute contraband. State v. Watson, 273 Kan. 426, 44 P.3d 357 (2002).

9. The district court may grant a departure sentence based on a small quantity of contraband when sentencing a defendant for illegally possessing contraband in prison. State v. Warren, 47 Kan. App. 2d 57, 270 P.3d 13 (2012).
