16-1801. Title; rights and duties not waivable or varied under terms of contract. (a) K.S.A. 16-1801 through 16-1807, and amendments thereto, shall be known and may be cited as the Kansas fairness in private construction contract act.

(b) The rights and duties prescribed by this act shall not be waivable or varied under the terms of a contract. The terms of any contract waiving the rights and duties prescribed by this act shall be unenforceable.

CASE ANNOTATIONS

1. Kansas fairness in private construction act does not directly prohibit the use of foreign forum selection clauses; such a clause found to be enforceable where parties were not Kansas citizens and Kansas courts routinely enforce such forum selection clauses in other cases. Bowen Eng'g, Corp. v. Pac. Indem. Co., 83 F. Supp. 3d 1185, 1190-92 (D. Kan. 2015).

2. A leaseholder with an option to buy the leased property does not have the property interests of an owner. Drywall Sys., Inc. v. Arnold of Kansas City, 57 Kan. App. 2d 263, 269, 450 P.3d 379 (2019).
