CASE ANNOTATIONS

1. Taking full legal interest in advance held not usurious. Tholen v. Duffy, 7 Kan. 405.

2. Scheme to avoid usury statute; payments considered payments on account. Savings Association v. Kidder, 9 Kan. App. 385, 389, 58 P. 798.

3. Defense of usury must be made at first opportunity. Hover v. Cockins, 17 Kan. 514, 517.

4. Penalty for usurious interest cannot be used as a set off. Fraker v. Cullum, Receiver, etc., 24 Kan. 679.
