CASE ANNOTATIONS
1. Prior adjudication order under the care and treatment act for mentally ill persons, without additional evidence, was not sufficient to prove defendant's mental status beyond a reasonable doubt. State v. Baumgarner, 59 Kan. App. 2d 330, 481 P.3d 170 (2021).
2. Provision prohibiting possession of firearm by a person who is or has been a mentally ill person subject to involuntary commitment does not violate the 2nd Amendment to the U.S. constitution or section 4 of the Kansas constitution bill of rights. State v. McKinney, 59 Kan. App. 2d 345, 481 P.3d 806 (2021).
3. The "knowingly" culpable mental state applies to possession of the firearm and being convicted of domestic violence within the preceding five years. State v. Beasley, 64 Kan. App. 2d 203, 204, 547 P.3d 617 (2024).
